CONVEYANCING WITH LEGAL CONTEXT
The property is important. The contract controls what happens next.
Queensland conveyancing is deadline-driven. A missed condition date, incomplete disclosure pack, unsuitable ownership structure or unresolved lender requirement can change the commercial outcome of the transaction.
Ensure Legal approaches the file as a legal transaction—not simply an administrative settlement. We explain the documents, identify the decisions that need instructions and keep the parties moving toward completion.

BUYING PROPERTY IN QUEENSLAND
Buyer conveyancing: know the contract, dates and property before settlement
A buyer’s conveyancing file begins with the contract and seller disclosure documents. The review should identify what you are buying, the conditions protecting you, the dates requiring action and anything that needs further investigation.
- Review the contract, special conditions, title information and disclosure pack
- Explain cooling-off, finance, building and pest and other contractual deadlines
- Order relevant searches and raise property-specific questions where appropriate
- Complete identity, transfer duty and ownership preparation
- Coordinate lender documents, settlement adjustments, final inspection and PEXA completion
Buying with family assistance? If the deposit or balance includes gifted or third-party funds, prepare the evidence early and keep your broker, lender and solicitor aligned.
SELLING PROPERTY IN QUEENSLAND
Seller conveyancing starts before the buyer signs
Queensland’s statutory seller disclosure regime applies to most sales. The seller generally needs to give the buyer an approved Form 2 seller disclosure statement and the prescribed certificates before the buyer signs the contract, subject to statutory exceptions.
- Prepare and check Form 2 and available prescribed certificates
- Review title, registered interests, notices and body corporate material
- Advise on the sale contract and proposed special conditions
- Track finance, inspection and other conditions after signing
- Coordinate discharge of mortgage, settlement adjustments and completion

PROPERTY LAW ACT 2023 (QLD)
Seller disclosure from 1 August 2025
The documents are not a last-minute settlement formality. Timing, completeness and delivery matter before the contract is entered into.
What the disclosure work may involve
- Confirming whether the statutory disclosure scheme applies or an exception may be relevant
- Preparing the approved Form 2 using accurate seller and property information
- Collating the title search, registered plan and other prescribed certificates
- Including body corporate certificate material for community titles property where required
- Addressing known notices, encumbrances and contract issues separately where necessary
