Land Subdivision and Reciprocal Easements: Legal Essentials for Property Developers

Are You Planning to Subdivide Your Land?

In Queensland, subdividing land—whether a simple 1 into 2 split or a larger-scale development—requires strict compliance with local council regulations. This process not only involves obtaining Development Approval (DA) but also navigating a range of legal conditions, including access rights, infrastructure provisions, environmental considerations, and stormwater management.

Many landowners or small developers underestimate the legal complexities involved. Without careful planning, unresolved access or title issues can delay development or lead to costly legal disputes.

Real Case: Reciprocal Easements Required by Redland City Council

We recently assisted a small developer with a 1 into 2 subdivision project on a waterfront property in the eastern suburbs of Brisbane, under the jurisdiction of Redland City Council. As both proposed lots (Lot 1 and Lot 2) required access to a shared jetty area, the Council imposed a condition that reciprocal easements be established between the lots.

In this project, our legal team drafted and structured Easement A and Easement B (shown as Emt A and Emt B on the subdivision plan), ensuring that both lots would retain legal and equitable access to the waterfront. Our documentation met all council requirements, and the reciprocal easements were successfully approved, allowing the subdivision to proceed without issue.

This case highlights a common legal requirement in subdivision projects—one that, if overlooked, could prevent contract settlements or result in future legal disputes between adjoining landowners.

Why Are Reciprocal Easements Important?

In a subdivision, an easement is a legal right that allows one parcel of land (the dominant tenement) to use part of another (the servient tenement) for a specific purpose, such as access or shared utilities. When subdivided lots will be owned by different parties, and shared use of certain areas is required, reciprocal easements ensure that both parties have equal, legally enforceable rights of use.

Establishing such easements involves formal legal documentation, council approval, and registration on the land title, making them binding on future owners and critical to the long-term functionality of the site.
