Legal Knowledge – Queensland House & Land Packages Sunset Clause: Know Your Rights

Are you planning to or have you already purchased a “House & Land Package” and are concerned about project delays that might lead the developer to use the sunset clause to terminate the off-the-plan contract and resell the property at a higher price due to land appreciation?

Please be aware that as of 22 November 2023, Queensland law requires that if developers wish to terminate a contract using a sunset clause, they must first obtain the buyer’s consent or seek approval from the Supreme Court.
