Removing a former partner from a Queensland property title does not automatically release them from the mortgage. Title ownership and loan liability are separate matters, and both need a clear plan after separation.
Title and mortgage are different records
The land title shows who owns the property. The mortgage records the lender’s security and the borrowers’ obligations. A person may be removed from title yet still remain liable under the loan unless the lender agrees to a refinance, replacement facility or discharge arrangement.
Start with the intended outcome
Review the court order, financial agreement or negotiated terms alongside the current title and mortgage. The documents should clearly identify the property, the outgoing owner, the retaining owner, any payment and the deadline.
Finance usually sets the timing
Where one person keeps the home, their lender may require a new application, refinance approval, valuation or payout of the existing loan. If the approval is delayed, the transfer cannot simply be registered while the old mortgage remains unresolved.
The Queensland transfer work
Once the settlement path is ready, the matter may involve duty assessment or an exemption claim, transfer documents, lender discharge and electronic settlement. Forms 1 and 24, identity evidence and the relevant title details are commonly part of the process.
Duty and family law documents
A family law order or agreement can be important to the duty analysis, but it does not remove the need to check the actual exemption requirements and lodge the correct material. Informal arrangements can have a different duty outcome.

What if a former partner will not cooperate?
The practical transfer steps depend on the rights created by the relevant order or agreement and the lender position. If there is an unresolved family law dispute, obtain advice from a family lawyer before assuming a conveyancing process can solve it.
