Responsibilities of a Professional Real Estate Lawyer: Risk Management and Client Protection

As a professional real estate lawyer, the primary responsibility is, of course, to successfully complete transactions for clients. However, risk management and safeguarding clients’ interests are equally important.

Recently, in a high-risk and high-value real estate transaction, after thoroughly analyzing the contract terms and the complex private loan approval conditions, our entire team decided not to proceed with the deal. We utilized the loan conditions to exit the contract and successfully recovered the full deposit.

It is important to note that in special cases, some clients may use private lending and “loan sharks” to complete transactions, which carries significant risks. Using complex company structures or trusts may not always reduce liability, and special attention must be given to the legal responsibilities behind personal guarantees.

A professional lawyer’s duty is not just to “follow the process,” but to carefully analyze the consequences of every decision. Experienced lawyers must have the courage to say “stop” to protect the client’s rights or minimize their losses.
