Drowning remains one of the leading causes of accidental death for young children in Australia. Between 1 January 2004 and 30 June 2010, 41 children under the age of five tragically drowned in swimming pools across Queensland. In response, the Queensland Government introduced new pool safety laws on 1 December 2010 aimed at preventing such tragedies.

Key Requirements Under the Pool Safety Laws
From 1 December 2010, all property owners with a regulated pool—including those at houses, townhouses, units, hotels, motels, backpacker accommodation and caravan parks—must adhere to a new pool safety standard. These requirements aim to provide consistent and effective protection for children.
Deadlines to Remember
- By 4 November 2011: All pool owners were required to register their pool with the Queensland Pool Safety Register. Failing to do so could result in fines of up to $2,000.
- By 30 November 2015: All pools had to comply with the new safety standard, unless the property was sold or leased earlier, in which case the deadline applied at the time of transfer.
What the Law Requires
Under current legislation, pools (including spas) that are deeper than 30cm must:
- Be registered on the Queensland Pool Safety Register
- Be fully fenced in accordance with the pool safety standard
- Have a valid Pool Safety Certificate before the property is rented or sold
- Display a CPR sign near the pool in a clearly visible position
These requirements apply whether the pool is permanent or temporary.

While legal compliance is crucial, proactive safety practices can make all the difference in preventing drowning incidents:
- Supervise children at all times in or near the pool.
- Ensure the fence is secure and compliant with the latest standards.
- Fit pool gates with self-closing latches and adjust them to open away from the pool.
- Keep surrounding landscaping maintained to prevent children from climbing over fences.
- Enrol children in water awareness and swimming lessons from an early age.
- Learn CPR and take annual refresher courses to stay prepared in case of an emergency.
