AFAD Exemption for Residential Land Developers in Queensland

Overview: A New Framework for Foreign Developer Relief

On 15 December 2025, the Queensland Revenue Office (QRO) introduced Public Ruling GEN012.1, a new administrative arrangement designed to provide eligible residential land developers with exemptions from:

  • Additional Foreign Acquirer Duty (AFAD) under the Duties Act 2001, and
  • Land Tax Foreign Surcharge (LTFS) under the Land Tax Act 2010.

This ruling replaces previous ex gratia relief processes and introduces a structured eligibility regime, pre-approval pathways, and a strict obligation to report “notifiable events.”

It applies to:

  • AFAD: for transfer duty liabilities arising on or after 15 December 2025
  • LTFS: for land tax liabilities arising on or after 30 June 2026

If you’re a foreign-controlled developer operating in Queensland, these changes may significantly impact your project structure, tax exposure, and compliance obligations.

Who Is This For?

This exemption applies to:

  • Foreign individuals or entities acquiring AFAD residential land for residential development
  • Foreign-controlled corporate groups with active development operations in Queensland
  • Developers intending to build 20 or more residential lots (with exceptions for regional areas and special projects)

Key Concepts Simplified

✅ Large Developer Threshold

An entity is considered a “large developer” if it develops or redevelops 20 or more residential lots in Queensland within a 12-month period. Averaging across up to 5 years is permitted.

✅ Qualifying Development

Land acquired must be intended for a residential development of 20+ lots, and the development must be primarily residential in nature.

✅ Corporate Group Tracing

If your entity is part of a group, you may rely on corporate group tracing (parent/subsidiary relationships with ≥90% ownership and voting control) to satisfy eligibility.

✅ Pre-Approval Available

Entities may seek pre-approval from QRO for both AFAD and LTFS exemptions—particularly helpful for recurring or large-scale developments.

✅ Notifiable Events

Once approved, the developer must notify QRO within 28 days of any change in structure, compliance status, or project use that could affect eligibility. Failure to notify may trigger AFAD/LTFS reassessment, interest, and penalties.

AFAD Exemption: Conditions Summary

To obtain an AFAD exemption under GEN012.1, the transaction must:

  1. Involve the transfer of AFAD residential land
  2. Meet the entity requirements
  3. Satisfy either:
    • The land is a qualifying development
    • The applicant is a large developer (including group entities)

Note: You cannot apply for this exemption if you are claiming the Build-to-Rent (BTR) concession under a separate QRO ruling.

LTFS Exemption: Conditions Summary

LTFS is not imposed if:

  • The entity meets the Australian-based requirements, and
  • The entity (or its group) qualifies as a large developer, and
  • The development is active and ongoing (not passively held)

⚠️ Important: Once development is completed and the land becomes a passive asset (e.g. retained or leased), the LTFS exemption no longer applies.
